Terms & Conditions

These terms govern the repair and restoration services provided by Gearhaven at our Bangkok workshop. Please read them before leaving a watch in our care.

1. Definitions

Agreement
— these Terms & Conditions together with any written work authorisation or service quotation issued by Gearhaven.
Service
— watch repair, movement servicing, luminous compound renewal, case work, or any other horology-related work carried out by Gearhaven.
We / Us / Our / Gearhaven
— Gearhaven, operating from 412 Thanon Ratchadamri, Lumphini, Pathum Wan, Bangkok 10330, Thailand.
User / You / Customer
— any individual or entity that leaves a timepiece in our care for the purpose of obtaining a Service.
Piece
— the watch, clock, or timepiece deposited with Gearhaven for servicing.
Quotation
— a written or verbal price estimate issued after inspection, prior to work commencing.

2. Acceptance of Terms

By leaving a timepiece with Gearhaven for servicing, or by approving a Quotation verbally or in writing, you confirm that:

  • You are at least 18 years of age and have legal capacity to enter into this Agreement.
  • You have read and understood these Terms & Conditions.
  • You are the lawful owner of the Piece, or are authorised to arrange work on the owner's behalf.
  • Where work is authorised on behalf of a third party, you accept personal liability for payment.

3. Service Description

Gearhaven currently offers the following services from our Bangkok workshop:

  • Quartz Movement Repair (REF-QMR) — inspection and fault rectification for battery-powered quartz movements.
  • Lume Refresh (REF-LMR) — renewal of luminous compound on dials and hands.
  • Pocket Watch Service (REF-PWS) — full mechanical service including mainspring renewal for pocket watches.

Services are available by appointment and walk-in at our Bangkok address. We do not offer postal or courier-in services at this time. Geographic availability is therefore limited to customers able to attend the workshop in person or through an authorised representative.

4. Service Delivery Terms

4.1 Inspection and Quotation

All Pieces are inspected before work commences. A Quotation is provided based on the inspection findings. No work begins until the Quotation has been accepted by the Customer. If additional issues are identified during the course of work, we will pause and seek fresh authorisation before proceeding.

4.2 Scope Changes

Work that falls outside the agreed scope will not be carried out without written or verbal authorisation. If authorisation cannot be obtained within a reasonable period, we will complete only the originally agreed work.

4.3 Turnaround Times

Indicative turnaround periods are given at the time of Quotation. These are estimates, not contractual commitments. Delays may arise from parts availability, the complexity of an individual piece, or workshop capacity. We will communicate delays as soon as they become known.

4.4 Collection

Customers will be notified when a Piece is ready for collection. Pieces not collected within 60 days of the notification date may be subject to a storage fee. Pieces left uncollected for more than 12 months will be treated as abandoned, and Gearhaven reserves the right to dispose of them in accordance with applicable Thai law.

4.5 Work Documentation

A written summary of work completed is provided with each Piece on return. This record details parts replaced, observations noted, and timing results where applicable.

5. Payment Terms

5.1 Prices

All prices are quoted and payable in Thai Baht (฿). Published service prices are starting prices; final figures depend on inspection outcomes and any additional components required.

5.2 Payment Methods

We accept cash (Thai Baht), Thai bank transfer (PromptPay), and major credit and debit cards. Payment is due in full on collection of the Piece, unless otherwise agreed in writing.

5.3 Cancellation and Refunds

If a Customer wishes to cancel after inspection but before work begins, no charge applies unless an inspection fee was agreed. If work has commenced, a charge for labour completed to that point is payable. Completed work is non-refundable; however, if a fault attributable to our workmanship becomes apparent within 90 days of collection, we will investigate and rectify at no additional charge where the fault is confirmed as our responsibility.

5.4 Parts

Replaced parts become the property of Gearhaven unless the Customer requests their return at the time of authorisation. Returned parts are provided as-is with no warranty.

6. User Responsibilities

By engaging our services, you agree to:

  • Provide accurate information about the Piece and any known history of prior repair or modification.
  • Disclose any known sensitivities (vintage movements, rare dials, collector significance) so that appropriate care can be taken.
  • Not deposit a Piece that you do not own or are not authorised to have serviced.
  • Not request work that would involve falsification of a watch's authenticity, misrepresentation of its origin, or any other fraudulent purpose.
  • Collect the Piece within a reasonable period after being notified of completion.

7. Intellectual Property

All content on the Gearhaven website — including text, imagery, layout, and branding — is the property of Gearhaven or is used under licence. You may not reproduce, distribute, or use this content for commercial purposes without prior written consent.

Nothing in this Agreement transfers any intellectual property rights relating to the Piece itself. The trademarks, designs, and brand elements of any watch manufacturer remain the property of those manufacturers.

8. Disclaimers

Watch repair involves inherent risk. Gearhaven takes all reasonable precautions, but by their nature, some older or previously damaged movements carry risks that cannot be entirely eliminated by a repairer. Specific risks include:

  • Brittle components in aged pieces that may fail during or after service.
  • Unavailability of original or equivalent replacement parts.
  • Vintage luminous compound that may react unexpectedly to cleaning or renewal processes.

We do not promise specific timekeeping accuracy outcomes. Results depend on the condition of the movement, age, and available parts. Our assessments are professional opinions, not formal horological certifications.

9. Limitation of Liability

To the fullest extent permitted under Thai law:

  • Gearhaven's total liability for any claim arising from a Service shall not exceed the amount paid by the Customer for that specific Service.
  • We are not liable for indirect, consequential, or incidental losses, including sentimental value, loss of use, or market value fluctuation.
  • We are not liable for pre-existing damage not disclosed at intake, or for failures arising from factors outside our workmanship.

Force majeure: Gearhaven will not be held liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, civil unrest, utilities failure, or actions of third parties.

10. Indemnification

You agree to indemnify and hold Gearhaven harmless from any claim, loss, or expense (including reasonable legal costs) arising from your breach of this Agreement, your misrepresentation regarding ownership or authorisation, or any unlawful use of our services.

11. Termination

Either party may terminate the service arrangement before work commences. Where work has begun, the Customer remains liable for the cost of work completed to date.

Gearhaven may decline to accept or continue work on a Piece where we have reason to believe the request is connected to unlawful activity, where the Customer has been abusive toward staff, or where completing the work would require us to act contrary to professional or ethical standards.

12. Dispute Resolution

12.1 Governing Law

This Agreement is governed by the laws of the Kingdom of Thailand, including the Civil and Commercial Code and the Consumer Protection Act B.E. 2522.

12.2 Informal Resolution

If a dispute arises, we ask that you contact us at [email protected] in the first instance. Most concerns can be resolved promptly through direct communication.

12.3 Jurisdiction

Disputes that cannot be resolved informally shall be submitted to the courts of Bangkok, Thailand.

13. General Provisions

  • Entire Agreement: This Agreement constitutes the entire understanding between the parties regarding the Service and supersedes prior discussions, representations, or arrangements.
  • Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver: Failure to enforce any provision does not constitute a waiver of the right to enforce it subsequently.
  • Assignment: You may not assign your rights or obligations under this Agreement without our written consent. Gearhaven may assign obligations to a qualified successor.
  • Notices: Notices may be given in person at the workshop, by email, or by telephone. Written confirmation is recommended for matters involving scope changes or cancellations.

14. Changes to These Terms

Gearhaven may update these Terms from time to time. The current version is always available on our website. The version in effect at the time a Quotation is issued governs that particular service engagement.

Continued use of our services after updated Terms have been published constitutes acceptance of those changes.
